Engadget HD Podcast 276 - 11.29.2011

Even with the holiday break, it's been a busy week and we've got plenty to discuss including some long-awaited events, like a new HD guide from Comcast, the DirecTiVo, and SlingPlayer for Boxee Box. That's not all however, since we're just a week away from Microsoft's latest assault on the living room with the new Xbox 360 dashboard, and with CES just over a month away rumors are heating up including news about Samsung and Google TV. We've also got our holiday shopping guide for 2011 to talk about, so check out that list and what we're watching over the next week and add in your suggestions in the comments below.

Survey says the best place to live is...

Vienna's excellent infrastructure, safe streets and good public health service make it the nicest place to live in the world, consulting group Mercer said in a global survey which put Baghdad firmly in last place.

German and Swiss cities also performed especially well in the quality of living rankings, with Zurich, Munich, Duesseldorf, Frankfurt, Geneva and Bern in the top 10.

The Austrian capital, with its ornate buildings, public parks and extensive bicycle network recently reduced the cost of its annual public transport ticket to 1 euro a day.

Serious crime is rare and the city of around 1.7 million inhabitants regularly tops global quality of life surveys.

But Mercer warned that top-ranking European cities could not take their position for granted in the survey, which assessed more than 200 cities.

"They are not immune to any decrease of living standards should this (economic) turmoil persist," Mercer's senior researcher Slagin Parakatil said on the company's website.

Mercer, which also ranked cities according to personal safety, gave Athens a poor score because of clashes between demonstrators and police and political instability.

"In 2011 Athens is ranked in Europe among the lowest in the personal safety ranking," Parakatil said.

Oslo also fell to 24th place in the separate safety survey because of Anders Breivik's mass killings in July. It would usually be in the top 15, Mercer said.

Baghdad's political turmoil, poor security enforcement and attacks on local people and foreigners made it the worst place to live in 2011, both in terms of life quality and safety, Mercer said.

Political and economic unrest in Africa and the Middle East also pushed down scores in those regions.

"Many countries such as Libya, Egypt, Tunisia and Yemen have seen their quality of living levels drop considerably," Parakatil said.

"Political and economic reconstruction in these countries, combined with funding to serve basic human needs, will undoubtedly boost the region."

He said that while the outlook is uncertain for most of the world because of economic and political turmoil, cities in Asia-Pacific look set to benefit thanks to political stability and solid growth.

Auckland, Sydney, Wellington, Melbourne and Perth made it into the top 20 for quality of life in 2011 while Singapore was the highest-ranking Asian city in 25th place.

Former Paraguay guerilla Marciano Villagra dies (AP)

ASUNCION, Paraguay ? A former guerrilla who battled two of Paraguay's military-led governments has died at age 93.

Marciano Villagra led Paraguay Communist Party guerrillas in various actions, including the brief takeover of the town of Piribebuy in 1947. He went into hiding after Gen. Alfredo Stroessner took power in 1954.

His daughter Irina Villagra said he died Monday from general infections.

Party leader Luis Casabianca said Villagra died in his home in the Asuncion neighborhood of Sajonia without ever finding the bodies of his son Derlis and brother Americo, who disappeared during Stroessner's reign. Villagra received the equivalent of about $50,000 in 2008 as indemnification for his persecution.

Appeal sped up over BofA $8.5 billion MBS accord (Reuters)

(Reuters) ? A U.S. appeals court on Wednesday sped up the review of a ruling that moved consideration of Bank of America Corp's (BAC.N) $8.5 billion settlement over mortgage debt to federal court from a New York state court.

The decision by the 2nd U.S. Circuit Court of Appeals in New York could help Bank of America, which intended the accord to address much of its remaining legal liability from its 2008 purchase of the mortgage lender Countrywide Financial Corp.

Bank of New York Mellon Corp (BK.N), which as trustee negotiated the accord, and investors such as BlackRock Inc (BLK.N) and MetLife Inc (MET.N) are hoping to reverse an October 19 ruling by U.S. District Judge William Pauley in Manhattan moving the case to his court from a New York state court.

Pauley said he took the case because it implicated "paramount federal interests" such as the integrity of nationally chartered banks and the vitality of financial markets.

The settlement applied to 530 mortgage securitization trusts with $174 billion of unpaid principal. It was intended to address claims by investors who said the seemingly safe securities that they bought proved toxic because they were backed by risky home loans that were underwritten poorly.

Bank of New York Mellon had negotiated the accord with 22 institutional investors including BlackRock and MetLife.

But objections were raised by many investors that were not part of the talks but would be bound by the outcome, including a group called Walnut Place.

Some of these investors said the $8.5 billion payout was too low. Moving the case to federal court could potentially make it easier to back out, or negotiate higher payouts.

In court papers, Bank of New York Mellon countered that delaying the appeal would "disrupt a settlement that is of enormous importance to investors."

Fallout from the Countrywide purchase has weighed on the share price of Charlotte, North Carolina-based Bank of America, which on Tuesday fell to its lowest level since March 2009.

Shares of the second-largest U.S. bank rose 37 cents, or 7.3 percent, on Wednesday to close at $5.44.

The 2nd Circuit did not say when it would consider the appeals. Bank of America was not part of either motion seeking expedited appeal.

The cases are Bank of New York Mellon v. Walnut Place LLC et al, 2nd U.S. Circuit Court of Appeals, Nos. 11-4554 and 11-4571.

Using Peltier elements (which are hot one side and cold the other), it's built three experimental uses for the gear. Thermodraw sits an element beneath a screen that changes temperature based on the colors painted -- an icy tundra will find the image cold to touch, Hawaii holiday snaps the opposite. Thermogame places the elements inside the controller, helping you navigate fire and ice hazards and Thermochair, which changes temperature if you get a message -- although we think it would make a handy backside warmer (and a great way to prank people into thinking they'd just lost bladder control). Colo. sheriff tossed in jail named after him

A former "sheriff of the year" has been arrested on suspicion of attempting to deal drugs in exchange for sex. Patrick Sullivan has been an iconic crime fighting figure in Colorado for decades, but tonight he's behind bars. NBC's Miguel Almaguer reports.

A former U.S. national sheriff of the year found himself in a jail that was named for him, accused of offering methamphetamine in exchange for sex from a male acquaintance.

Colorado lawman Patrick Sullivan, 68 ? handcuffed, dressed in an orange jail uniform and walking with a cane ? watched Wednesday as a judge raised his bail amount to a half-million dollars and sent him to the Patrick J. Sullivan Jr. Detention Facility.

The current sheriff, Grayson Robinson, who worked as undersheriff for Sullivan from 1997 until he took over the job in 2002, said the department was shocked and saddened at his arrest.

Robinson said the case is still under investigation, including where and how Sullivan might have gotten the drugs. He declined to say if authorities suspect Sullivan of using drugs, or if others might be charged.


Sullivan's arrest has many in suburban Denver's Arapahoe County where he held sway for nearly two decades wondering what happened to the tough-as-nails lawman they once knew ? a law officer known for his heroism in saving two deputies and for his concern about teenage drug use.

"This isn't the Pat I know," said Peg Ackerman, a lobbyist for the County Sheriffs of Colorado who often worked with him on legislation. She said he was concerned about drug use in schools and was a chief of security at a school district.

At the brief hearing, Judge William Sylvester told Sullivan not to contact anyone involved in the case.

Sullivan's attorney, Kevin McGreevy, did not return calls seeking comment.

Sullivan came to the attention of law enforcement after an Oct. 4 call to authorities from a home in Centennial, according to an arrest affidavit. The deputy who responded had worked for Sullivan and knew who he was.

After investigating further, the deputy learned from two confidential informants that Sullivan was dealing meth but would sell it only if they had sex with him, the document stated. He was arrested after police set up a sting at a home.

Deputies found that Sullivan had handed someone a bag of meth and had another bag on him when he was searched, according to the affidavit. Both bags weighed less than a gram.

Sullivan served as sheriff from 1984 until his retirement in 2002.

In 2002, then-U.S. Rep. Tom Tancredo praised him on his retirement, citing Sullivan for promoting homeland security and for being named Sheriff of the Year by the National Sheriff's Association.

In 1989, Sullivan was hailed as a hero. During a gunman's rampage, he rescued two deputies after crashing his truck through a fence and protecting them while they were loaded into the vehicle.

While those who know Sullivan were puzzled by the news, some said they weren't surprised that a person of his stature could get involved. They said meth users will do almost anything to feed their habit and often hurt others in the process.

"This drug knows no economic, social, professional or occupational boundaries," said state Rep. Ken Summers, who served on a legislative meth task force.
