32GB Nexus 7 now available in the UK at Currys + PC World, priced ?199.99

UK retailers PC World and Currys is now offering the 32GB Nexus 7 for sale. The stores, which are both part of the Dixons group, are selling the new Nexus 7 model for £199 inc. VAT, matching Google’s Play Store price. Home delivery is available, as is the option to reserve online and collect in person, assuming you’re near a PC World or Currys store. All the stores in our area seem to have stock, so if you’re anywhere near a major city, stock levels shouldn’t be a problem.

Announced on Monday, the 32GB Nexus 7 sells at the same price point occupied by the 16GB model since launch. The cheaper 8GB model has since been discontinued, and the £159 ($200) spot is now occupied by the 16GB’er.

So far there’s no sign of the 32GB 3G Nexus 7 in the UK, either at retail or in the Google Play Store. UK carrier Three will offer that version at subsidized prices, but currently offers no release date.

New materials may help prevent infections by blocking initial bacterial attachment

ScienceDaily (Oct. 26, 2012) ? Bacteria's ability to cling to virtually any surface is a vexing problem in the medical community. Engineering a surface that can easily slough off these dangerous bugs has, until recently, had limited success. Recently, however, a team of British researchers has discovered a new class of materials that resists bacterial attachment. Now these scientists from the University of Nottingham, U.K., are ready to set out on the approval process that will take their research to the clinical testing stage, paving the way for medical applications.

The researchers will present their findings at the AVS 59th International Symposium and Exhibition, held Oct. 28 -- Nov. 2, in Tampa, Fla.

To date, scientists have been unable to fully explain how bacteria are able to adhere so durably to virtually any surface. Despite this limited understanding of bacteria-material interactions, the Nottingham researchers were able to screen thousands of different chemical combinations for resistance to bacterial adhesion. The studies revealed that one particular class of compounds, acrylates with hydrophobic groups, proved highly resistant to bacteria's sticky tendencies.

"The new materials are to bacteria what non-stick cookware is to food," said Andrew Hook, a researcher at the Nottingham School of Pharmacy. "Bacteria can stick to the surface of [traditional] medical devices and form a community, known as a biofilm, where the bacteria become highly resistant to antibiotics and the immune system."

By preventing the biofilm from forming on devices in service, the new materials help the immune system to simply eliminate the bacteria as if the device had never been inserted. In contrast, current antibacterial materials, like silver, actually kill bacteria.

After the new non-stick materials were identified, they were successfully tested on surfaces in the laboratory and on standard medical devices, such as catheters, within an animal model. In laboratory studies of the new materials, the researchers found a 96.7-percent reduction in bacterial coverage compared to commercially available silver-containing catheters for the bacterium Staphylococcus aureus.

By coating medical devices with the optimal polymer composition of one of this class of acrylates, for example the compound tricyclodecane-dimethanol diacrylate that the researchers tested, scientists believe they can prevent bacteria from attaching and also prevent associated infections, which could reduce health care costs.

The researchers are now ready to take their research to the next level and prepare the regulatory package to begin clinical trials. They hope the trials will show that by denying bacteria a foothold on medical equipment in humans, the chances of a patient contracting a medical device-associated infection are much lower.

Nottingham pharmacy professor Morgan Alexander hopes that since no antibiotics are used this will lead to a method to reduce infections from bacteria without the risk of antibiotic resistance developing. "The challenge now is to have materials recognized by the medical device industry," Alexander said. "That would allow us to develop products for specific applications. There's a lot of potential to improve human health, but we need to prove that."

The researchers are in discussions with potential partners to develop coated devices and are hopeful their material could reach the market in 5 to 10 years.

Opinion: Obamacare Is Bad For Small Business ? CBS Los Angeles

As the final days of the presidential campaign of 2012 wind down, there is ongoing concern about what President Barack Obama?s law for requiring businesses to provide health care for its employees will do to small business owners. The choices that business owners have are few, and none of the choices are attractive at all for the American entrepreneurs who are scarcely making it in this Obama economy. Yet, these business owners must make a decision ? and make it quick ? before the financial penalties begin to accrue against them.

The choices for small business owners are clear, and they all involve a forceful blow to their financial bottom line. They can either spend the money it will take from their business ? and their hopes of expanding their business ? to provide insurance for all of their workers. Or, they can pay the hefty fines that the government will now levy against them if they do not provide insurance for their employees. The next option is to keep their business incredibly small ? under 50 employees ? so that they will continually have under the number of employees that are required to feel the full effects of the Obamacare law.

All options for these small business owners lead to one obvious conclusion. They will have less money and limited staff to grow their businesses into a business that could one day allow them to expand and offer Americans more jobs. It?s a detrimental process that has no positive for the growth of a small business.

It has been suggested that most small business owners have decided that paying the fine will be less costly to them than actually purchasing insurance for all of their employees. All-in-all, it appears that Chief Justice John Roberts of the Supreme Court was absolutely correct when he said that the Affordable Care Act is a tax. It is, even though President Obama denies that it?s a tax. Again, it was Judge Roberts? contention that it is a tax that justified ? in his own mind ? that the law should pass through the Supreme Court.

Of course, there is another option. Obama could be defeated, and Mitt Romney could repeal the law as he promises to do on day one of his presidency.

Just a reminder to business owners: Election Day is November 6.

Telus plans LG Optimus G launch on November 13th, other carriers remain shy

LG committed to launching its mostly superb Optimus G to the three major carriers in Canada sometime in November. Just which day the phone would arrive was left a mystery, though, even when Rogers started taking pre-orders. It's taking another provider to sort things out: Telus has gone on the record with plans to carry the quad-core smartphone starting November 13th, right at the height of what could be a busy month. That's all that the future-is-friendly network can say for now, although Rogers may have provided the remaining piece of the puzzle when it gave out $130 contract and $600 outright prices. We have a hunch Telus wouldn't want to be the exception to the rule.

Baby boomer model Dorothy Brooks, looking better the second time ...

Wow. We?ve run lots of stories on BoomerCaf? about people reinventing themselves. But this one takes the cake: Dorothy Brooks, now 60, has become a model. For the second time. And she?s loving it.

I call myself an Ex-Flowerchild, which I am proud to be! And now I?m equally proud ? at the age of 60 ? to be a model!!

It?s all possible because our generation has been fighting aging, tooth and nail. The picture years ago of a 60-year-old woman with grey hair, her figure gone, with very little exercise and turned to seed, is outdated. At least in my life; I always said I would fight that.

And my mother, who died ten years ago, was my role model. She was a model in the Fifties for the classic New York department store Bergdorf Goodman. She is the one who took me to a model agency when I was 17.

Then 27 years ago, when I moved to Washington D.C., I signed with an agency in upscale Georgetown, and did print, runway, and commercials.

Several years later I started my own casting agency and eventually it went from just 40 models to a data base of 2,000. I spun off into photography shooting actors, models, CD covers, executives, whatever I could do that clients needed.

Many people along the way had asked me to model again. But I was running the agency and didn?t think much about it until it hit me this year: looking at ads and commercials targeted at baby boomers, I put the rebirth of my modeling career on the Bucket List.

And now I?m doing it. Why? Maybe because I had so much fun as a model in my 20s that I want to recapture some of my youth, make more money, meet people, and show women that you can be sexy and fun at any age. I have not had facial cosmetic surgery but I am not opposed to it; most likely one day I will do it, just to weed out the garden. Ha!!

I have had a lot of fun putting together a portfolio at the age of 60. Being on the front side of the camera again, I am reminded that it is a lot of work to get that perfect expression that will sell the product.

But I am excited to see where it takes me. Our road is different at 60 than it was at 20. I can?t afford to miss a second. I have sent pictures to the prominent agency Ford Models. Their ?classic? division is terrific and of course they have top clients. If things work out, I?ll work for some of them. The need for actors and models for print ads is huge these days. And baby boomers are the audience.

My makeup is on ? and my fingers are crossed.

IPC The Hospitalist 3Q earns up, but guides lower

NORTH HOLLYWOOD, Calif. (AP) ? IPC The Hospitalist Company Inc. said Thursday that its net income rose 21 percent in the third quarter as it added more providers. But it lowered its full-year earnings expectations because it's leaving some facilities and expects fewer patients in others.

Earnings in the July-September quarter came to $7.8 million, or 46 cents per share, from $6.5 million, or 38 cents per share, in the same quarter a year ago. Analysts polled by FactSet expected higher profit of 49 cents per share.

Revenue rose 12 percent to $127.7 million. Analysts had forecast $130.1 million.

The North Hollywood, Calif., company, which provides medical services in 28 states, said patient encounters grew 13 percent to 1.3 million. But revenue per patient fell 2.4 percent as the company's physicians focused more on post-acute care ? what patients need after being discharged from hospitals ? than acute care, when severe cases typically require immediate treatment.

Administrative expenses rose 14 percent to $20.7 million because of the cost of opening new regional offices.

The Hospitalist lowered its guidance because of its plan to leave some contracted facilities and general softness in patient counts at U.S. hospitals.

It now expects full-year earnings between $1.88 and $1.92, down from $1.96 to $2.06. Analysts expect $2 per share. It narrowed its full-year revenue forecast to $520 million to $524 million, from its earlier estimate of $520 million to $530 million. Analysts expect $522.8 million.

The Hospitalist shares dropped 17 cents to $41.73 in after-hours trading. They had risen 22 cents to close at $41.90 before results were released.

Welcome to our weekly roundup of the best posts from the blogs of academic publishers! We found a great selection of posts this week, and many of the best focus on various political aspects of higher education. As always, if you particularly enjoy something or think that we missed an important post, please let us know in the comments.

We?ll start things off this week with a couple of excellent articles looking at the Fisher v. University of Texas at Austin Supreme Court case. First, at Voices in Education, the blog of Harvard Education Publishing, Sylvia Hurtado takes a detailed look at the court transcript for the Fisher case. She finds it interesting that neither side of the case challenges ?diversity as a compelling interest? or ?the educational benefits of diversity in college,? but that the petitioner?s lawyers are instead questioning how much diversity is enough diversity to achieve these benefits, and whether race-neutral affirmative action policies can make a school diverse enough.

At North Philly Notes, the blog of Temple University Press, Elizabeth Aries looks at the possible impact of the Fisher v. University of Texas at Austin. She goes into detail in describing the ?educational benefits of diversity at college? that Hurtado mentions, explaining that ?students did not fail to notice what classmates had and did not have, not only in terms of material possessions, but in terms of the opportunities they had to go out to eat, take spring break trips, to make connections to pre-professional summer jobs and to good jobs after graduation.? She argues that reducing the diversity on campuses will reduce these chances for students to learn.

Meanwhile, at the Penn Press Log, John P. Spencer has a guest post reminding his readers that educational reform has been an important part of civil rights movements for a long time. He looks back at the way that school reform became a crucial battleground for civil rights battles in the 1960s, in particular. He points out similarities between reform arguments in the ?60s and those today, with a major point of concern being ?how to focus on ? external factors while maintaining high expectations of schools??

Another hot-button issue in the racial politics of education is that of undocumented students attempting to make it into and through college. At From the Square, the blog of NYU Press, Michael A. Olivas argues that, while President Obama?s Deferred Action for Childhood Arrivals policy is a step in the right direction, it?s not enough help for these students. Olivas claims that appropriately forceful legislation can only come out of Congress.

October 22-28 is Open Access Week, and the MITPressLog has a weeklong series of blog posts reflecting on open access. On Monday, John Willinsky looked at the progress in the availability of research and scholarship made possible by the explosion of communication technologies over the last few decades. While he recognizes some of the negative implications of what he calls the ?mega-journal model,? he believes that ?an irrevocable evolution toward this opening of research and scholarship is underway.?

Both total and average student debt numbers continue to climb, and at Beacon Broadside, Alan Michael Collinge argues that ?[t]his issue has grown ? from a significant problem to a major crisis.? In his guest post, Collinge lays out some of the startling facts about the student debt crisis and advocates public grassroots action as the best way to start bringing about reform.

Of course, issues of educational reform are hardly the only political issues that seem to be getting short shrift this political cycle. With such a heavy focus on righting the economy, many important problems are going undiscussed by either presidential campaign. At the JHU Press Blog, Peter Beilenson notes that urban issues are of crucial importance to the well-being of the country, though you?d never guess that this is the case from the presidential debates. Beilenson lays out a ?four-legged stool? of factors that affect urban success and wonders how each candidate will address each of the ?legs.?

In the Princeton University Press Blog?s Election 101 series, John McGinnis continues his discussion of the money that goes into campaign advertising. Building on his argument that campaign advertising is necessary to inform inattentive voters, he wonders how we can address issues of inequality in campaign financing without losing the potential for benefits from campaign advertising.

In Massachusetts this November, voters will decide whether to legalize physician-assisted suicide (Washington state and Oregon both have similar laws now on the books). At The Chicago Blog, Margaret Morganroth Gullette discusses the Massachusetts decision, as well as the ?broader context of conversation surrounding American ageism and government rhetoric.? While she acknowledges the problems inherent in the Act in question, she claims that she will be voting for it in November.

At the Harvard University Press Blog, Craig Stanford reminds us that there is a world beyond that of the 2012 US elections, and that it?s a world that could well face the extinction of many of the species of the great apes over the next few decades. Stanford believes that one method that could result in better protection of the apes is what he calls ?ecotourism.? By looking at how the tourism business has benefited gorillas in Africa over the last few years, he shows that ecotourism is a viable short-term way to help ensure that some, at least, of the great apes are protected.

The ineffectiveness and general awfulness of business meetings have long been the subject of jokes. At the AMACOM Books Blog, Martin Murphy has a guest post explaining why it is that meetings can be so unproductive. He believes that ?[t]he primary reason that meetings fail is that content and process are not separated,? and claims that meetings should be run by a ?trained facilitator? who can make sure that ?content and process are given equal attention.?

It is surprising to learn that ?the United States has in the twenty-first century a larger missionary force than ever before.? However, as Sarah E. Ruble claims at the UNC Press Blog, missionary culture has grown consistently throughout America?s history, despite the fact that missionary work is largely now the work of evangelical organizations rather than the ?mainline Protestant groups? that traditionally provided the bulk of the missionary force. In her post, Ruble discusses how perceptions of missionary work have changed in the years since World War II.

And finally, we?ll close things up this week with a fascination rumination on the use of the word ?choice? in politics and ethics written by Daniel Callahan at the OUPblog. Callahan, the author of a book on abortion that drew fire from both pro-life and pro-choice sides of the debate (though neither had laid claim to those particular designations at that point), is uniquely placed to see ?how choice seems to have become the all-purpose ethical term, used by liberals and conservatives, right and left.? In his post, he shows how laying claim to the ?choice? label is one of the most successful political moves available (showing how, most recently, ?choice? was used against Mayor Bloomberg in his campaign against oversized sugary beverages).

Romney backs Mourdock as Obama continues criticism

(AP) ? Republican Mitt Romney is standing behind Indiana Senate hopeful Richard Mourdock as President Barack Obama's campaign keeps up criticism of Romney's ties to a candidate who said pregnancies that result from rape are "something God intended."

Romney's campaign has said he disagreed with Mourdock's remark, which came in a debate Tuesday with his opponent, Rep. Joe Donnelly. But Romney is standing by his endorsement of Mourdock ? and not asking the Indiana state treasurer to take down an ad Romney filmed Monday in support.

The remark thrust a contentious social issue back into the presidential race as Election Day draws near. Early voting has begun in many states, and Obama himself plans to vote Thursday in Chicago. It's an inopportune time for Republicans, who had been seeing gains in polls among female voters critical to a Romney victory. Democrats are eager to link Romney and other Republican candidates to Mourdock's remarks.

"Romney must withdraw his support of Mourdock? who'd force rape victims to bear an attacker's child as 'God intended,'" Obama's campaign wrote on the president's campaign Twitter account.

On "The Tonight Show" Wednesday, Obama criticized Mourdock for his comments, saying "rape is rape" and distinctions offered by the Republican candidate "don't make any sense to me."

Obama campaign aides see Romney's refusal to pull his support for Mourdock as an opportunity to cast the GOP nominee as extreme on women's health issues and expose what they say are Romney's attempts to moderate those views for political gain.

"Romney has campaigned as a severe conservative, supports severely conservative candidates, and would be a severely conservative president ? especially on issues important to women," Obama deputy campaign manager Stephanie Cutter wrote in a fundraising plea Wednesday evening. She called Mourdock's remarks "one of the most demeaning comments about women" from a politician.

The Republican nominee and his traveling staff spent Wednesday avoiding questions on the subject. Romney did not speak to reporters or address Mourdock's remarks during two public appearances. His aides sometimes speak to reporters traveling on Romney's campaign plane but did not appear Wednesday ? and were scarce at Romney's rallies. They ignored repeated emailed questions about Mourdock.

Less than two weeks before Election Day, opinion polls depict a close race nationally. Romney's campaign claims momentum as well as the lead in Florida and North Carolina, two battleground states with a combined 44 of the 270 electoral votes needed to win. Obama's aides insist the president is ahead of or tied with his rival in both those states and in the other seven decisive battlegrounds.

Obama was campaigning with all the signs that his presidency is on the line, crossing the country Wednesday with rallies in Iowa, Colorado and Nevada and appearing on the "The Tonight Show" in California. In the 17th hour of his day, he stood in a park on a cool, crisp night before thousands of supporters in Las Vegas. By then it was nearly 1 a.m. in Washington, where his day had begun, and Obama's voice still boomed.

"If you're not going to sleep, you might as well be in Vegas," Obama said before encouraging people to cast their votes early, as Nevada law allows. He met later with employees at the Bellagio hotel.

On Thursday, Obama was so not much starting his day as continuing his last one. After spending the night on Air Force One, he's campaigning in Tampa, Fla., Richmond, Va., and Cleveland before heading back to the White House.

In the midst of the 40-hour dash across six battleground states and eight states overall, he planned to do exactly what he is imploring millions of people to do for him: vote.

In his hometown of Chicago, Obama was scheduled to be the first president to vote early in person. By making a special trip just to cast his vote, Obama sought to build awareness about the early voting option, which is a vital part of both campaigns' political operations.

"I can't tell you who I'm voting for," Obama told a crowd of thousands gathered in chilly Denver on Wednesday. "It's a secret ballot." He noted that his wife, Michelle, had already voted by absentee ballot and she promised she went for him.

Taken together, the nonstop travels were the busiest single stretch of Obama's long and combative run for a second term.

He is selling a more specific second-term agenda these days and warning that Romney is untrustworthy, but increasingly, Obama's goal is to ensure his supporters get to the polls.

Romney was waking up in Cincinnati to kick off a daylong swing through three Ohio towns, sharpening his focus on a state that's critical to his hopes of winning the White House. The Republican's advisers say their internal data has him tied to win the state's 18 electoral college votes, but public polling has shown Obama with a slim lead.

Romney is working to cast Obama's campaign as focused on small issues while the Republican ticket is focused on fixing the nation's serious fiscal problems.

"His campaign seems to be smaller and smaller by the day," Romney told more than 2,000 people in an airplane hangar off the tarmac in Cedar Rapids, Iowa, his campaign plane looming behind him. "Attacking me is not an agenda for the future."

Syria accused of cluster bomb use in civil war

BEIRUT (AP) ? The Syrian regime was accused Sunday of dropping cluster bombs ? indiscriminate scattershot munitions banned by most nations ? in a new sign of desperation and disregard for its own people.

The international group Human Rights Watch cited amateur video and testimony from the front lines in making the allegation against the government of President Bashar Assad.

Syria and Turkey, meanwhile, declared their skies off-limits to each other amid mounting cross-border tensions in Syria's 19-month-old conflict, now a civil war. Turkey is an outspoken backer of rebels trying to oust Assad.

The weekend's mutual ban on overflights is part of Turkey's increasingly assertive stance toward Syria that has stirred concerns about a regional conflagration. In the past two weeks, Turkey has retaliated for stray Syrian shells and mortar rounds, intercepted a Syrian passenger plane on suspicion it carried military equipment, and ? according to a Turkish newspaper Sunday ? sent more warships to naval bases north of the Syrian coastline.

Inside Syria, rebel fighters and regime forces have been locked in a bloody stalemate for weeks, with rebels holding large rural stretches in the heavily populated western area, but unable to dislodge Assad's troops from urban centers. During the summer, the regime escalated shelling and airstrikes on rebel-held neighborhoods.

Human Rights Watch said new amateur videos and interviews with residents suggests the Syrian air force has dropped cluster bombs in the past week, mainly along a main north-south highway in western Syria that runs through Maaret al-Numan, a town captured by rebels after fierce fighting.

Cluster bombs open in flight, scattering smaller bomblets over a wide area. Many of the bomblets don't explode immediately, posing a threat to civilians long afterward.

Steve Goose, an arms expert for the New York-based human rights group, said most nations have already banned cluster bombs and that many of those who haven't, including the United States, said they would do so soon.

"These are weapons that are really beyond the pale," Goose said in a phone interview. "This is a weapon of desperation (for Syria) at this point in time. Only those governments and political leaders who are willing to thumb their nose at international opinion will use these weapons."

The Syrian government had no immediate comment.

First word of cluster bombs being dropped by the regime emerged in July, but the recent reports indicated a more widespread use, said Nadim Houry, a Lebanon-based researcher for Human Rights Watch.

Sunday's report said activists posted at least 18 videos in the past week showing remnants of the bombs in or near the central city of Homs, the northern cities of Idlib and Aleppo, rural areas near the town of Latakia and the eastern Ghouta district close to the capital of Damascus. The group also spoke to residents in the towns of Taftanaz and Tamane who said cluster bombs were dropped in their areas on Tuesday.

There was no immediate report of casualties from the recent cluster bombs, the report said, adding that the munitions shown in the videos were made in the Soviet Union, a major arms supplier to Syria before its collapse in 1991.

Amateur videos cannot be confirmed independently because Syria restricts access to foreign journalists and the government keeps a tight lid on news related to the conflict, which it blames on a foreign conspiracy.

Cluster bombs have also been used in other recent conflicts in the region, including by forces loyal to Libyan leader Moammar Gadhafi, who was toppled in a bloody uprising last year, and by Israel in its 2006 war with the Lebanese Hezbollah militia. U.N. demining experts have said hundreds of thousands of bomblets dropped over Lebanon failed to explode and still endanger civilians.

The death toll in Syria's civil war crossed the threshold of 33,000, according to the Britain-based Syrian Observatory for Human Rights, which gathers reports from a network of activists.

The group said it counted 33,204 dead as of Friday, including 23,752 civilians or civilians-turned-rebel gunmen, 1,241 army defectors fighting with the rebels and 8,211 regime soldiers.

In Turkey, the leader of Syria's main opposition group complained that the international community is doing little more than managing the conflict. The rebels' foreign backers, including Turkey, have shied away from direct military intervention, fearing to get dragged into a quagmire without an exit strategy.

Abdelbaset Sieda, who heads the Syrian National Council, told reporters in Istanbul that the international community must establish safe havens in Syria and enforce no-fly zones to help the rebels counter the regime's airstrikes.

This would also cut down on the number of Syrians seeking refuge abroad and "resolve the humanitarian crisis, especially with winter approaching," Sieda said. International aid officials estimate the number of refugees could double by the end of the year, to more than 700,000.

Earlier this year, Turkey floated the idea of safe zones, but has since backed off.

Turkey has taken a notably harsher stance toward Syria since the start of the month and warned of retaliation if Syrian artillery hits Turkish soil again. The daily newspaper Hurriyet said in an unattributed report that Turkey has reinforced four naval bases along its Mediterranean coast north of Syria. The newspaper said Turkey sent frigates with cannons, as well as anti-ship and anti-aircraft missiles.

Foreign Minister Ahmet Ahmet Davutoglu said Sunday that Turkey is barring Syrian civilian flights from Turkey's airspace, a day after Syria issued a similar ban for Turkish commercial aircraft.

"As of yesterday, our airspace which was closed to Syrian military flights, has also been closed to civilian flights by Syria," Davutoglu said. He alleged that Syria is "abusing" civilian flights by using them to transport military equipment

Turkish planes, including some that flew Hajj pilgrims to Saudi Arabia, have been taking alternate routes since Wednesday, the day Turkey intercepted the Syrian passenger plane. At the time, Turkey said Syrian airspace was no longer safe and barred Turkish planes from taking that route. Turkish planes carrying pilgrims are now flying over northern Cyprus and Jordan, according to Turkey's Radikal newspaper

For the first time, a street gang operating in the United States has been officially designated a transnational criminal organization, empowering officials to more aggressively target the group, Mara Salvatrucha MS-13, which engages in the drug, sex, and human trafficking trades.

MS-13 is an El Salvador-based gang that over three decades has developed into a violent criminal force from Los Angeles to Washington, D.C.

Naming the gang a transnational criminal organization suggests how the group has evolved from being primarily a criminal element in Central American immigrant communities to a regional organized crime network delving into a range of illegal markets, experts in North and Central American crime patterns say.? ?

The designation, announced by the Treasury Department Thursday, aims at shutting down MS-13?s financial operations, which have grown increasingly sophisticated as the gang has matured from its roots in Los Angeles among young Salvadoran refugees escaping their country?s civil war in the 1980?s.

?This action positions us to target the associates and financial networks supporting MS-13, and gives law enforcement an additional tool in its efforts to disrupt MS-13?s activities, said David Cohen, Treasury undersecretary for terrorism and financial intelligence, in a statement announcing the designation.

?MS-13,? Mr. Cohen said, ?is an extremely violent and dangerous gang responsible for a multitude of crimes that directly threaten the welfare and security of US citizens, as well as countries throughout Central America.?

The gang has grown to include more than 30,000 members, with branches operating in Guatemala, Honduras, and Mexico, according to the Treasury. The FBI estimates the gang?s membership to be much higher.

At least 8,000 MS-13 members ? often identified by elaborate tattoos that incorporate the gang?s name ? operate in 40 states and the District of Columbia, Treasury officials say.

MS-13 ? ?mara? is slang for ?mob,? while Salva is short for Salvador ? became infamous for the ruthlessness it employs in extorting from mom-and-pop immigrant businesses and in forcefully recruiting young Salvadoran immigrants and Salvadoran-Americans into its ranks.

The gang is seen as having toned down its violence in some of the communities where it is most deeply established, some California law enforcement officials say. But the gang?s growth has shifted in recent years to the Salvadoran immigrant communities of the East Coast, experts say, and there the violence has continued.

In recent years cases have multiplied, particularly in Virginia and New York, of teenage girls who have been forced into prostitution and kept there under threat of violence. Salvadoran boys who resist the gang?s recruiters are sometimes subject to the especially intense wrath of local gang leaders.

In one highly publicized case, two MS-13 members were convicted in Alexandria, Va., in 2005 for the murder of a young pregnant woman who was targeted for her cooperation with federal officials who were investigating the gang?s activities.

US efforts at tackling MS-13?s illegal operations have rippled back to El Salvador, which is the destination of at least part of the gang?s financial proceeds. In recent years federal law enforcement officials pressed for the deportation of hundreds of MS-13 members from southern California ? an action that overwhelmed El Salvador?s law enforcement capabilities and resulted in a sharp spike in violence.

Some of the deported MS-13 members formed new arms of the gang in El Salvador, some regional criminal justice experts say, then in turn moved to develop branches of their newly formed groups in the US.

Digitization is not infringement

Digitization of even copyrighted works for the specific purposes of allowing better, faster, easier searches, allowing access to the Visually-impaired and creating back-up copies for owners of the originals has been held to be fair use under the U.S. copyright statute by U.S. District Court Judge Harold Baer, Jr., in New York.

The case ? The Authors Guild et al. v. HathiTrust et al. ? was brought by the Authors Guild on behalf of all copyright holders to stop the digitization of works by HathiTrust, a consortium of university libraries using Google?s services and digitizing their book collections.

The ruling, handed down late on Wednesday, did not reach the most controversial issue ? the digitizing of so-called orphan works (copyrighted works whose author has not been and, perhaps, cannot be located) ? an issue the judge said wasn?t ripe for judicial decision since the program never actually went into effect. The decision was otherwise a total victory for HathiTrust.

The facts

The court opinion described the facts this way:

Defendants have entered into agreements with Google, Inc. (?Google?), that allow Google to create digital copies of works in the Universities? libraries in exchange for which Google provides digital copies to Defendants (the ?Mass Digitization Project? or ?MDP?). The HathiTrust partnership is in the process of creating ?a shared digital repository that already contains almost 10 million digital volumes, approximately 73% of which are protected by copyright.? After digitization, Google retains a copy of the digital book that is available through Google Books, an online system through which Google users can search the content and view ?snippets? of the books. Google also provides a digital copy of each scanned work to the Universities, which includes scanned image files of the pages and a text file from the printed work. According to Plaintiffs, this process effectively creates two reproductions of the original. After Google provides the Universities with digital copies of their works, the Universities then ?contribute? these digital copies to the HathiTrust Digital Library (?HDL?). The Complaint alleges that in total, twelve unauthorized digital copies are created during this digitization process. Google?s use of the digital works is the subject of a separate lawsuit.

For works with known authors, Defendants use the works within the HDL in three ways: (1) full-text searches; (2) preservation; and (3) access for people with certified print disabilities. The full-text search capabilities allow users to search for a particular term across all the works within the HDL. For works that are not in the public domain or for which the copyright owner has not authorized use, the full-text search indicates only the page numbers on which a particular term is found and the number of times the term appears on each page.

The Guild?s position was that the copyrights of authors were being violated by digitizing the works regardless of the use that?s made of the digitized copies thereafter, that the mere scanning of the works and their storage digitally is a copyright violation, and, of course, that any distribution of any aspect of the copies online was not permitted.

HathiTrust took the position that everything it wanted to do (minus the orphan work project, which it suspended because of difficulties in checking the copyright status of the works to be included) was within the fair use exception to copyright protection.

Both sides agreed that there weren?t any facts that required a trial and that the case could be decided as a matter of law (in legal parlance, this was decided based on competing motions for summary judgment).

The court ruling

Judge Baer agreed with HathiTrust that the fair use doctrine protected the copying.

First, the fair use doctrine examines the ?purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes.? 17 U.S.C. ? 107(1). As to this factor, the judge concluded that while preservation of the original alone might not be enough, in combination with making access available to the visually-handicapped and permitting full-text searches that return page numbers where the search term is found, HathiTrust?s uses were transformative (meaning a new use, different from the original), favoring a finding of fair use.

The second fair use factor, the nature of the work copied, would ordinarily tilt towards the authors because the record showed much of the material copied was fiction. But the judge held the factor was not dispositive because ?the use is transformative, intended to facilitate key-word searches or access for print-disabled individuals.?

The third fair use factor considers how much of a copyrighted work is copied compared to the purpose of the copying. Here, Judge Baer said:

?[T]he extent of permissible copying varies with the purpose and character of the use.? The question is whether ?no more was taken than necessary.? Sometimes it is necessary to copy entire works. ?Intermediate? copies may not be infringing when that copying is necessary for fair use. Here, entire copies were necessary to fulfill Defendants? purposes of facilitation of searches and access for print-disabled individuals. ? Plaintiffs argue that Defendants did not need to retain copies to facilitate searches; however, the maintenance of an electronic copy was necessary to provide access for print-disabled individuals.

The last fair use factor is the effect on the market for the copied works. To the authors? argument that ?[e]ach digital copy of a book that Defendants created . . . rather than [purchased] through lawful channels, represents a lost sale,? the judge noted that ?purchase of an additional copy would not have allowed either full-text searches or access for the print-disabled individuals, two transformative uses that are central? to the copying program.

And to the argument that the digitization prevented the authors from developing a licensing system, the judge rejected the argument as conjecture and held that copyright holders ?cannot preempt a transformative market.? In other words, the fact that the authors might want to create some licensing scheme down the road can?t block this transformative use now.

The bottom line, according to the court, was that the ?copyright law?s ?goal of promoting the Progress of Science . . . would be better served by allowing the use than by preventing it.?? Therefore, ?(t)he enhanced search capabilities that reveal no in-copyright material, the protection of Defendants? fragile books, and, perhaps most importantly, the unprecedented ability of print-disabled individuals to have an equal opportunity to compete with their sighted peers ? protect the copies made by Defendants as fair use??

The judge concluded: ?Although I recognize that the facts here may on some levels be without precedent, I am convinced that they fall safely within the protection of fair use ? I cannot imagine a definition of fair use that would not encompass (these) transformative uses ? and would require that I terminate this invaluable contribution to the progress of science and cultivation of the arts ??

What this means for us

So? what does this mean for genealogists?

To the extent that digitization allows full-text searching of millions of resources held in libraries around the country, it?s a wonderful thing. Being able to find out what books contain references to specific people and specific places should help us target our research in a way that hasn?t been possible before.

Because the HathiTrust decision doesn?t permit even snippets of copyrighted texts to appear online ? only page numbers where a search term appears will be shown ? it should have a minimal effect on the market for genealogy and other reference books.

It may stop people from buying books based on nothing more than the hope that a particular title will have a reference to a person or place we want, and that may well affect the bottom line of small-volume publishers. For all our sakes, since those publishers are important to us, we can hope that it also sparks sales of books where we?ll now know there is a reference we?re interested in.

Me, I?ve found that when I can see a snippet, or when I know that a book names a person or place I?m researching, I?m far more likely to buy the book than when it just has an interesting title.

So? tentatively (and remember: this decision can and likely will be appealed), my take is:
